Acceptance of These Terms

These Terms of Service ("Terms") are entered into by and between you and Pocket Cinema LLC ("Pocket Cinema," "Company," "we," "us," or "our"). These Terms govern your access to and use of the Pocket Cinema website, mobile applications, streaming platform, content, and any related services, features, products, rewards, subscriptions, purchases, and functionality (collectively, the "Services").

By accessing or using the Services, creating an account, purchasing Coins, subscribing to Premium, watching content, redeeming rewards, downloading content, or otherwise using Pocket Cinema, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms or our Privacy Policy, you may not access or use the Services.

If you are using the Pocket Cinema mobile application through the Apple App Store or Google Play Store, you may be required to affirmatively accept these Terms during account creation or checkout. Your acceptance creates a legally binding agreement.

Eligibility and Age Requirements

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or purchase subscriptions, Coins, or content.

Individuals between the ages of 13 and 17 may use the Services only with the involvement, supervision, and consent of a parent or legal guardian.

Pocket Cinema is not directed toward children under the age of 13, and we do not knowingly collect personal information from children under 13.

By using the Services, you represent and warrant that:

  • You are legally able to enter into a binding agreement;

  • You meet the eligibility requirements described in these Terms; and

  • All information you provide to Pocket Cinema is accurate and complete.

Account Registration and Security

To access certain features, you may be required to create an account.

You agree to:

  • Provide accurate, current, and complete registration information;

  • Maintain and promptly update your account information;

  • Keep your login credentials confidential;

  • Be responsible for all activity that occurs under your account; and

  • Notify us immediately if you suspect unauthorized use of your account.

You may not share your account credentials with others or permit unauthorized access to your account.

Pocket Cinema reserves the right to suspend, restrict, or terminate accounts that violate these Terms or appear to be compromised, fraudulent, abusive, or otherwise unauthorized.

Free and Premium Services

Pocket Cinema offers both free and premium experiences.

Free users may access selected content supported by advertisements and may have limited access to:

  • Video quality;

  • Premium-only episodes or series;

  • Offline downloads;

  • Early access content;

  • Simultaneous streams;

  • Device syncing;

  • Ad-free viewing; and

  • Certain features or rewards.

Premium users may receive additional benefits, including:

  • Ad-free viewing;

  • Access to premium-only content;

  • Early access to episodes, seasons, or releases;

  • Higher video quality, including HD, Full HD, and 4K where available;

  • Offline downloads;

  • Enhanced device syncing;

  • Expanded simultaneous streaming access; and

  • Priority support.

Pocket Cinema may modify, add, remove, or discontinue features, content, rewards, pricing, or access tiers at any time.

Subscription Plans and Billing

Pocket Cinema may offer weekly, monthly, yearly, or other subscription plans.

By purchasing a subscription, you authorize Pocket Cinema or the applicable App Store provider to charge your selected payment method on a recurring basis until canceled.

Unless otherwise stated, subscriptions automatically renew at the end of each billing cycle.

You may cancel your subscription at any time through:

  • Your Apple App Store subscription settings;

  • Your Google Play subscription settings; or

  • Your Pocket Cinema account settings, where available.

If you cancel, you will continue to have access to Premium benefits until the end of your current paid billing period.

Pocket Cinema may change subscription prices at any time. If we change pricing, we will provide advance notice where required by law.

Except where required by law or by the policies of Apple, Google, or another payment provider, subscription payments are non-refundable.

Coins, Rewards, and Virtual Currency

Pocket Cinema may offer virtual Coins, rewards, bonuses, referral credits, streak bonuses, engagement rewards, or similar digital items (collectively, "Coins").

Coins:

  • Are virtual items only;

  • Have no cash value;

  • Are not redeemable for money;

  • Are not your personal property;

  • Cannot be transferred, sold, traded, gifted, or exchanged outside of the Services; and

  • May only be used within Pocket Cinema as permitted by us.

Users may obtain Coins by:

  • Purchasing them;

  • Daily rewards;

  • Referral programs;

  • Streak bonuses;

  • Sharing content;

  • Watching advertisements;

  • Enabling notifications;

  • Participating in promotions; or

  • Other activities designated by Pocket Cinema.

Pocket Cinema reserves the right to:

  • Modify the value of Coins;

  • Change redemption requirements;

  • Add or remove reward opportunities;

  • Expire Coins after periods of inactivity;

  • Revoke Coins obtained through suspicious, fraudulent, or abusive behavior; and

  • Suspend or discontinue the Coins system entirely.

Any suspected abuse, including fake referrals, bots, scripts, multiple account creation, manipulated shares, device spoofing, payment fraud, or any attempt to game the system may result in immediate forfeiture of Coins, account suspension, or permanent termination.

Episode Unlocks and Purchases

Certain content, episodes, or features may require:

  • Coins;

  • A subscription;

  • A one-time purchase; or

  • A combination of the above.

Pocket Cinema may permit users to unlock:

  • Individual episodes;

  • Bundles of episodes;

  • Entire seasons;

  • Premium content; or

  • Early access content.

Unlocked content is licensed, not sold.

Your access to unlocked content may remain available only while:

  • The content remains on the Services;

  • Pocket Cinema retains the necessary rights;

  • Your account remains active and in good standing; and

  • Your payment or purchase is valid.

Pocket Cinema does not guarantee permanent availability of any specific content.

Advertising

Free users may see advertisements before, during, or after content playback.

Advertisements may include pre-roll, mid-roll, post-roll, banners, branded content, sponsorships, product placements, referral offers, upgrade prompts, or interactive promotions.

Premium users generally will not receive standard playback advertisements, but Pocket Cinema may still display:

  • Promotional messages;

  • New release announcements;

  • Feature announcements;

  • Premium upgrade offers;

  • Branded integrations within content; or

  • Sponsored editorial experiences.

Playback, Downloads, and Device Restrictions

Pocket Cinema content may be available in:

  • Vertical 9:16 format;

  • Horizontal 16:9 format; or

  • Other formats depending on the content.

Playback quality may vary depending on:

  • Your subscription status;

  • Your internet connection;

  • Device compatibility;

  • Region;

  • Content availability; and

  • Technical limitations.

Free users may be limited to lower playback quality. Premium users may receive access to higher quality playback, including 4K where available.

Pocket Cinema may allow certain users to download content for offline viewing.

Downloaded content:

  • May expire after a period of time;

  • May expire if your subscription ends;

  • May require periodic internet reconnection;

  • May not be available for all titles;

  • May be limited by device type, operating system, region, or storage space.

Pocket Cinema may limit the number of:

  • Devices linked to an account;

  • Simultaneous streams;

  • Offline downloads;

  • Logins per device; and

  • Shared account sessions.

Content Availability and Geographic Restrictions

Pocket Cinema content may vary by country, region, language, device, or platform.

Certain content may be unavailable in your region due to licensing, legal restrictions, age ratings, or other reasons.

You agree not to use VPNs, proxies, location spoofing, or other methods to bypass geographic restrictions.

Pocket Cinema may add, remove, modify, delay, or discontinue content at any time without notice.

Intellectual Property Rights

All content, software, features, technology, trademarks, branding, graphics, user interface elements, videos, text, logos, music, artwork, sound design, trailers, clips, scripts, and other materials available through the Services are owned by Pocket Cinema or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.

You receive only a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial entertainment purposes.

You may not:

  • Copy;

  • Reproduce;

  • Redistribute;

  • Publicly display;

  • Publicly perform;

  • Sell;

  • License;

  • Edit;

  • Repackage;

  • Broadcast; or

  • Exploit any Pocket Cinema content without prior written permission.

Anti-Piracy and Prohibited Conduct

You agree not to:

  • Record your screen while viewing content;

  • Capture or rip streams;

  • Download content outside approved download tools;

  • Re-upload episodes, scenes, screenshots, or clips to other platforms without authorization;

  • Share content on torrent sites, piracy sites, Telegram groups, Discord servers, YouTube, TikTok, Instagram, or file-sharing services without permission;

  • Circumvent advertisements, paywalls, DRM protections, geo-blocking, access controls, or security systems;

  • Use bots, scrapers, scripts, automation, or reverse engineering tools;

  • Modify, hack, interfere with, or damage the Services;

  • Attempt to gain unauthorized access to Pocket Cinema systems;

  • Use the Services for illegal, fraudulent, or abusive purposes; or

  • Impersonate another person or misrepresent your identity.

Pocket Cinema reserves the right to investigate violations and may take any action we deem appropriate, including:

  • Removing content;

  • Suspending or terminating accounts;

  • Revoking purchases, Coins, or subscriptions;

  • Issuing DMCA notices;

  • Pursuing civil claims;

  • Reporting activity to law enforcement.

User Contributions and Interactive Features

Pocket Cinema may permit users to create profiles, usernames, favorites, reviews, comments, watchlists, referrals, profile photos, ratings, messages, shares, or other user-generated content.

You retain ownership of your user-generated content, but by posting or submitting it, you grant Pocket Cinema a worldwide, perpetual, royalty-free, sublicensable license to use, reproduce, modify, distribute, display, promote, and otherwise use such content in connection with the Services.

You agree not to submit content that:

  • Is unlawful;

  • Is defamatory, threatening, abusive, hateful, discriminatory, or harassing;

  • Violates another person's rights;

  • Contains malware or harmful code;

  • Contains spam or commercial solicitations;

  • Impersonates another person; or

  • Violates these Terms.

Pocket Cinema may remove any user content at any time and for any reason.

Mature Content Warning

Pocket Cinema features content across genres including horror, thriller, crime, action, sci-fi, western, psychological drama, suspense, and other mature categories.

Certain content may contain:

  • Violence;

  • Blood or gore;

  • Frightening imagery;

  • Strong language;

  • Sexual references;

  • Drug or alcohol references;

  • Flashing lights;

  • Disturbing themes; or

  • Other material that may not be appropriate for all viewers.

Viewer discretion is advised.

Parents and guardians are responsible for supervising minors who use the Services.

Privacy and Communications

Your use of the Services is also governed by our Privacy Policy.

By creating an account or using the Services, you consent to receive:

  • Transactional emails;

  • Account notifications;

  • Purchase confirmations;

  • Password reset emails;

  • Subscription notices;

  • Promotional emails;

  • Push notifications; and

  • Other communications related to your use of the Services.

You may opt out of certain marketing communications, but you may still receive important account or transactional messages.

Account Suspension, Termination, and Deletion

Pocket Cinema may suspend, restrict, or terminate your account at any time if:

  • You violate these Terms;

  • We suspect fraud, abuse, piracy, or unauthorized activity;

  • Your payment fails;

  • You misuse rewards or Coins;

  • We are required to do so by law; or

  • We discontinue the Services.

You may request deletion of your account at any time through your account settings or by contacting Pocket Cinema support.

Deleting your account may result in the loss of:

  • Coins;

  • Rewards;

  • Purchase history;

  • Watchlists;

  • Downloads;

  • Playback history; and

  • Access to previously unlocked content.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

POCKET CINEMA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.

Pocket Cinema does not guarantee that:

  • The Services will be uninterrupted;

  • Content will always be available;

  • The Services will be error-free;

  • Downloads will remain accessible forever;

  • Playback quality will always meet your expectations; or

  • The Services will be free of viruses or security vulnerabilities.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POCKET CINEMA, ITS AFFILIATES, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

THIS INCLUDES DAMAGES RELATED TO:

  • LOST PROFITS;

  • LOST DATA;

  • LOST CONTENT;

  • LOSS OF GOODWILL;

  • BUSINESS INTERRUPTION;

  • ACCOUNT TERMINATION;

  • LOSS OF COINS OR REWARDS;

  • PLAYBACK FAILURES;

  • SERVICE OUTAGES; or

  • CONTENT REMOVAL.

Nothing in these Terms limits liability that cannot legally be excluded.

Indemnification

You agree to defend, indemnify, and hold harmless Pocket Cinema, its affiliates, licensors, employees, contractors, officers, directors, successors, and assigns from and against any claims, damages, liabilities, losses, costs, or expenses arising from:

  • Your use of the Services;

  • Your violation of these Terms;

  • Your user-generated content;

  • Your misuse of Coins or rewards;

  • Your violation of intellectual property rights; or

  • Your unlawful conduct.

Governing Law and Arbitration

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any dispute arising from these Terms or the Services will be resolved through binding arbitration on an individual basis, except that either party may bring qualifying claims in small claims court.

You agree that:

  • Arbitration will be conducted in Los Angeles County, California, unless otherwise required by law;

  • You waive the right to participate in class actions or class arbitrations;

  • Claims must be brought within one year after the event giving rise to the claim; and

  • The Federal Arbitration Act governs these arbitration provisions.

If you wish to opt out of arbitration, you must notify Pocket Cinema in writing within 30 days after first accepting these Terms.

App Store Provider Terms

These Terms are between you and Pocket Cinema only, and not with Apple, Google, or any App Store provider.

Apple, Google, and their subsidiaries are not responsible for:

  • The Services;

  • Maintenance or support;

  • Warranty claims;

  • Legal claims;

  • Product liability claims; or

  • Intellectual property claims.

Pocket Cinema remains solely responsible for the Services.

Apple and Google are third-party beneficiaries of these Terms and may enforce applicable provisions against you.

Changes to These Terms

Pocket Cinema may revise these Terms from time to time.

If we make material changes, we may provide notice through the website, app, email, or other communications.

Your continued use of the Services after updated Terms become effective means that you accept the revised Terms.
